Updates to Terms of Use - April 2021

We have updated the Car Next Door Member Agreement, Owner Agreement and Damage Policy.

The following is a summary of the key changes. It is provided for your convenience only, and may not describe every change that has been made. Please read the new version of the documents on our Terms of Use page.

By continuing to use the service, you acknowledge and agree to the terms of the current Member Agreement and Policies (and Owner Agreement, if you have listed a car through the service).

If you do not agree to the new terms and wish to cancel your membership, or if you have any questions about these changes and how they affect you, let us know by email to members@carnextdoor.com.au.

 

Changes to the Member Agreement

Summary of change

10.10 

States you are not covered under Our Insurance Policy and are liable if the Vehicle is stolen while it is in your possession and you:

   a) fail to report the Vehicle as stolen to the police and to Us as soon as reasonably possible after becoming aware of the theft; 

   b) fail to provide a copy of the police report to Us as soon as reasonably possible after it is available to You; or 

   c) provide false or misleading information to Us or to the police or fail to provide Us or the police with any relevant information in connection with the theft.

13.1(c)

States you must follow any instructions given by Us by email at the start of a Booking Period, and before driving the Vehicle.

14.1 - 14.6

States that you must report and deal with the theft of a Vehicle in the same way as you report and deal with an accident or break-down.

14.11

States that Roadside Assistance charges are set out in the Fee Schedule.

18.3

States that the Borrower will be responsible if the Vehicle is damaged if the Vehicle is not left in a legal, unrestricted parking space at the end of a Booking Period.

States that Damage and Loss includes any applicable taxes.

 

Changes to the Owner Agreement

States that the definition of Owner is a member who wants to make a vehicle available to share.

Inserts a definition of Your Vehicle to be a Vehicle that You make available to share.

3.1(c)

States that if the Owner is not the registered owner of the Vehicle, the Owner has received permission from the registered owner to share the Vehicle.

4.1(e)

Increased the odometer limit for eligible Vehicles from 300,000km to 400,000km.

5.1 and 5.2

States that we may send you Lockbox System and related in car technology to self install

Deletes the reference to us charging you the monthly rental fee for the Lockbox system

7.2(b)

States any Tolling Device or Lockbox System that we sent to you to self-install but you have not self installed or are not using, needs to be returned to Us.

8.1

States that we may, with Your consent, send stickers to You to apply to your Vehicle.

9.1(e)

States that you must comply with any state laws or regulations applicable to Vehicles that are hired out without a driver

9.1(g) States you must follow any reasonable direction in relation to sharing Your vehicle that, in Our reasonable view, is necessary for to avoid harm to Our reputation and brand.
17.1 States that you are liable for any costs, damage, fines or or penalties if Your Vehicle does not meet the Vehicle Eligibility criteria set out in clause 4.1
