Uber and Car Next Door - terms and conditions

$40 DRIVING CREDIT AND $200 BONUS INCOME OFFER PROMOTION FOR UBER MEMBERS

  1. Instructions on how to claim and the reward(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer, except for the $2,000 income guarantee for eligible vehicles.
  2. Existing members of Car Next Door are ineligible to claim.
  3. This offer will be promoted via email communications sent by UBER Australia Limited (“UBER”). Individuals must first receive an email sent directly to them by UBER with a promotional code.
  4. Promotion opens at 12.01am AEST on 22 March 2021 and closes at 11.59pm AEST on 19 April 2021 (“Promotional Period”)
  5. To submit a claim, individuals must during the Promotional Period: 
    1. visit www.carnextdoor.com.au (“the Website”) or the Car Next Door App
    2. follow the prompts to apply to become a member
    3. when prompted, insert the code provided in the email
  6. To be eligible to receive the $40 driving credit reward individuals must: (a) complete the ID verification process in the Car Next Door website or app and be approved by Car Next Door to book and drive through the platform; (b) meet the Promoter’s member eligibility criteria and (c) complete a trip within three months of being approved (the “Credit Eligibility Period”).
  7. If the $40 driving credit is not used in the member’s first trip, any remaining driving credit will be applied to other trips commencing during the Credit Eligibility Period.
  8. Driving credit can be used to cover the cost of time and distance booking charges. It cannot be used to pay for other expenses such as booking fees, membership fees, fines, or damage and loss liability. Driving credits will have an expiry date and are not transferable or redeemable for cash.
  9. To be eligible to receive the $200 bonus income reward individuals must: (a) complete their application to share their car in accordance with clause 5 before the expiry of the Promotional Period; (b) have their application accepted by the Promoter; (c) make their car available for bookings through the Car Next Door Platform within 3 months after completing their application; and (d) meet the Promoter’s car and member eligibility criteria.
  10. Individuals acknowledge and agree that when signing up, they may be offered a sharing plan that incurs a monthly membership fee. Members can choose to list their car with a fee-free sharing plan and may cancel their membership at any time.
  11. The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  12. Only one claim permitted per person.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. All successful claimants will receive credit on their Car Next Door member account to the value of $200. The credit will be applied on the first invoice that is issued after the claimant lists their car on the platform and their car’s first booking is completed. The bonus income will be set off against any sharing plan fee and any other amounts owing for that invoice period. (Note that on the date that a car is first made available for bookings, the claimant will be charged a pro-rata membership fee covering the remaining days of the month. The promotional credit will not be applied in respect of this payment.
  15. Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified
  16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate
  17. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid
  18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion
  19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward.
  20. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.carnextdoor.com.au/docs/CND_Privacy_Policy.pdf. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose claimant’s personal information to any entity outside of Australia.
